DMCA & Copyright Policy
MerryKeep respects the intellectual property rights of others and expects our customers to do the same. Because our products are personalized with content you provide (names, dates, photos), you are responsible for ensuring you have the right to use any content you upload.
Filing a DMCA takedown notice
If you believe that content on merrykeep.com infringes your copyright, please send a written notice to support@merrykeep.com with the subject line “DMCA Notice”, including:
- Identification of the copyrighted work you claim has been infringed;
- The exact URL(s) on merrykeep.com where the allegedly infringing material appears;
- Your full name, mailing address, telephone number and email address;
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf;
- Your physical or electronic signature.
Upon receiving a valid notice, we will promptly remove or disable access to the material in question and notify the party who provided it.
Counter-notification
If you believe your content was removed by mistake or misidentification, you may send a counter-notification to the same address including: identification of the removed material and its former location; a statement under penalty of perjury that you have a good-faith belief the material was removed in error; your name, address and phone number; consent to the jurisdiction of the federal district court for your address (or, if outside the US, any judicial district in which MerryKeep may be found); and your signature.
Repeat infringers
We will terminate the accounts and refuse orders of customers who repeatedly submit infringing content.
